Following an article in the AD and in various other media, the discussion regarding smoke-free terraces has been reignited. KHN advocates for a welcoming hospitality industry. Smokers are also welcome on the terrace. It is one of the few opportunities where guests can smoke.
So, what is the situation now?
Can your guests simply continue smoking on the terrace then? What exactly is the situation? KHN outlines the facts for you: Smoking is now prohibited throughout the entire hospitality industry. However, private rooms, smoking rooms, and the open air (including terraces) are exempt from the smoking ban. These exceptions are regulated in the Smoking Ban Decree, which is part of the Tobacco Act. Therefore, your guest may simply smoke on the terrace. You are, of course, free to designate a smoke-free zone on your terrace.
Covered terrace
Smoking on an outdoor terrace is also permitted under an awning or parasol-shaped structure, provided that the terrace is fully open on at least one side (top or side). Furthermore, the terrace must not cause a nuisance caused by smoke inside your catering establishment. A permanent extension, such as a conservatory, cannot be classified as a terrace.
Also check the NVWA website (Netherlands Food and Consumer Product Safety Authority) for more explanation on what is and isn't allowed on a terrace regarding the smoking ban.
